{"id":4395,"date":"2005-06-08T09:29:12","date_gmt":"2005-06-08T13:29:12","guid":{"rendered":"http:\/\/www.thecarpetbaggerreport.com\/archives\/4395.html"},"modified":"2005-06-08T09:29:12","modified_gmt":"2005-06-08T13:29:12","slug":"there-may-be-a-war-on-drugs-but-this-is-ridiculous","status":"publish","type":"post","link":"https:\/\/stevebenen.com\/thecarpetbaggerreport\/there-may-be-a-war-on-drugs-but-this-is-ridiculous\/","title":{"rendered":"There may be a &#8216;war on drugs,&#8217; but this is ridiculous"},"content":{"rendered":"<p>I realize that prosecutors have grown overzealous about going after drug users, but <a href=\"http:\/\/www.ajc.com\/metro\/content\/metro\/atlanta\/0605\/07a1deadindict.html\">this story<\/a>, brought to my attention by Carpetbagger regular PWalker, shows that sometimes a district attorney&#8217;s office can go a little too far.<\/p>\n<blockquote><p>Jason Warner was killed last fall, but that didn&#8217;t stop Fulton County prosecutors from bringing drug charges against the Atlanta man this spring.<\/p>\n<p>&#8220;Judge, I think he&#8217;s dead,&#8221; a probation officer said when Warner&#8217;s marijuana possession case was called before Judge Alford Dempsey last week.<\/p>\n<p>Dempsey shook his head and said, &#8220;I guess we&#8217;re indicting the dead now.&#8221;<\/p>\n<p>The judge ordered the case &#8220;dead docketed,&#8221; a legal status akin to being in permanent limbo.<\/p><\/blockquote>\n<p>For all the talk from conservatives about taxing the dead through estate taxes, it&#8217;s a shame there isn&#8217;t more concern about prosecuting the dead. I guess &#8220;death indictments&#8221; doesn&#8217;t have the same flair as &#8220;death tax.&#8221;<\/p>\n<blockquote><p>&#8220;When you start indicting dead people, it would indicate to me the power is not being used prudently,&#8221; [Mike Mears, director of the Georgia Public Defender Standards Council] said. &#8220;That certainly indicates there&#8217;s been a lack of attention to the people.
