Bush wants to sidestep judicial oversight while eavesdropping on phone calls and Dems and their liberal allies aren&#8217;t happy about. This misses the fact that plenty on the right are plenty concerned about what&#8217;s transpired.<\/p>\n<p>* <b>On the Hill<\/b> &#8212; On Friday, Senate Judiciary Committee Chairman Arlen Specter (R-Pa.) expressed <a href=\"http:\/\/www.thecarpetbaggerreport.com\/archives\/6107.html\">serious concern<\/a> about the spy program and vowed to hold hearings after lawmakers reconvene in the new year. Over the weekend, Senator Lindsey Graham (R-S.C.) suggested Bush <a href=\"http:\/\/www.cbsnews.com\/htdocs\/pdf\/face_121805.pdf\">exceeded his authority<\/a> and may have circumvented the law. Yesterday, Republican Sens. Chuck Hagel (Neb.) and Olympia Snowe (Maine) joined three Senate Dems in demanding a full-scale <a href=\"http:\/\/www.realcities.com\/mld\/krwashington\/news\/nation\/13451356.htm\">congressional investigation<\/a> into the domestic-surveillance program.<\/p>\n<p>* <b>Among the scholars<\/b> &#8212; Bruce Fein, a conservative constitutional scholar and former deputy attorney general in the Reagan Administration, said yesterday that the president is <a href=\"http:\/\/www.washtimes.com\/commentary\/bfein.htm\">flouting the Constitution<\/a> and may have committed an <a href=\"http:\/\/thinkprogress.org\/2005\/12\/20\/conservative-scholars-argue-bush%e2%80%99s-wiretapping-is-an-impeachable-offense\/\">impeachable offense<\/a>. Norm Ornstein, a conservative scholar at the American Enterprise Institute, echoed Fein, <a href=\"http:\/\/www.wamu.org\/programs\/dr\/05\/12\/19.php\">saying<\/a>, &#8220;I think if we&#8217;re going to be intellectually honest here, this really is the kind of thing that Alexander Hamilton was referring to when impeachment was discussed.&#8221;<\/p>\n<p>* <b>Former administration officials<\/b> &#8212; Former Secretary of State Colin Powell questioned the president&#8217;s conduct on ABC&#8217;s Nightline, <a href=\"http:\/\/thinkprogress.org\/2005\/12\/21\/colin-powell-criticizes-spying-program\/\">saying<\/a>, &#8220;My own judgment is that &#8212; it didn&#8217;t seem to me, anyway, that it would have been that hard to go and get the warrants [through FISA]. And even in the case of an emergency, you go and do it [begin surveillance]. The law provides for that. And three days later, you let the court know what you have done, and deal with it that way.&#8221;<\/p>\n<p>* <b>Former Republican lawmakers<\/b> &#8212; Former Rep. Bob Barr (R-Ga.) was <a href=\"http:\/\/transcripts.cnn.com\/TRANSCRIPTS\/0512\/16\/sitroom.03.html\">nearly apoplectic<\/a> about Bush&#8217;s conduct, suggesting the president &#8220;deliberately order[ed] that federal law be violated,&#8221; and &#8220;ignored&#8221; the Constitution.<\/p>\n<p>* <b>The conservative blogosphere<\/b> &#8212; Though plenty of right-wing supporters of the president are rallying to his defense, a few conservatives who usually back Bush, including <a href=\"http:\/\/boortz.com\/nuze\/200512\/12192005.html#spy\">Neil Boortz<\/a> and <a href=\"http:\/\/www.qando.net\/details.aspx?Entry=3106\">Jon Henke<\/a>, believe the administration went too far with this program.<\/p>\n<p>There&#8217;s no reason this controversy has to be about partisanship, and it&#8217;s encouraging to see some Republicans acknowledge this. There are <a href=\"http:\/\/www.hillnews.com\/thehill\/export\/TheHill\/News\/Frontpage\/122005\/patriot.html\">plenty<\/a> <a href=\"http:\/\/www.kansascity.com\/mld\/kansascity\/13445932.htm\">of<\/a> <a href=\"http:\/\/atrios.blogspot.com\/2005_12_11_atrios_archive.html#113486383788554537\">hacks<\/a> out there, but when it comes to this controversy, the right is not unified behind Bush.<\/p>\n<p>We&#8217;re talking about a situation in which the president exceeded his authority and circumvented the law.
