Tim Johnson (D-S.D.), only 59 years old, <a href=\"http:\/\/www.rawstory.com\/news\/2006\/Senator_Tim_Johnson_reportedly_suffers_stroke_1213.html\">suffered a stroke<\/a> today on Capitol Hill.<\/p>\n<blockquote><p>There is no word, currently, on the Senator&#8217;s condition.<\/p>\n<p>A call from RAW STORY to Johnson&#8217;s office has not yet been returned.<\/p><\/blockquote>\n<p>Obviously, our thoughts and best wishes are with Johnson and his family.<\/p>\n<p>In a secondary political context, and without so much as a hint of knowing the seriousness of Sen. Johnson&#8217;s stroke, I thought I&#8217;d add that if the senator were no longer able to serve, <a href=\"http:\/\/legis.state.sd.us\/statutes\/DisplayStatute.aspx?Type=Statute&#038;Statute=12-11-1 \">state law<\/a> mandates that the governor, in this case Mike Rounds (R), call for a special election. It does not appear that Rounds would name a replacement (who, presumably, would be a Republican and shift the balance of the Senate).<\/p>\n<p>Stay tuned.<\/p>\n<p><em>Update<\/em>: <a href=\"http:\/\/www.cnn.com\/POLITICS\/blogs\/politicalticker\/2006\/12\/south-dakota-senator-in-hospital-for.html\">CNN reports<\/a> that Johnson was taken by ambulance to a hospital after experiencing &#8220;stroke-like symptoms.&#8221; He is undergoing a &#8220;comprehensive evaluation&#8221; by the stroke team at the hospital, according to a statement from Johnson&#8217;s office. Johnson&#8217;s office is not classifying it as a stroke at this point because they say that is not known. They do say he was conscious when he went to the hospital about 1130 a.m. ET this morning.<\/p>\n<p><em>Second Update<\/em>: I&#8217;ve seen <a href=\"http:\/\/blogs.wsj.com\/washwire\/2006\/12\/13\/sen-johnson-hospitalized-for-possible-stroke\/\">conflicting information<\/a>; now it appears Rounds may be able to name a replacement, should it be necessary.<\/p>\n<p><em>Third Update<\/em>: OK, maybe here&#8217;s the <a href=\"http:\/\/www.thecarpetbaggerreport.com\/archives\/9332.html#comment-106773\">resolution<\/a>: Rounds would name a temporary replacement, but that would only last until a special election was held.<\/p>\n<p><em>Fourth Update<\/em>: CBS News <a href=\"http:\/\/www.cbsnews.com\/stories\/2006\/12\/13\/politics\/main2258875.shtml\">reports<\/a> that earlier reports about the senator suffering a stroke or heart attack are incorrect. The network added, however, &#8220;Sources close to the situation tell CBS News the situation is definitely not good.&#8221; The report did not elaborate as to what that may mean.<\/p>\n<p>As for the legal question &#8212; and any commenters have added excellent insights; thanks to all &#8212; CBS&#8217;s report went on to say that South Dakota state law says that the governor can appoint a replacement when there is a &#8220;vacancy,&#8221; but Secretary of State Chris Nelson explained that it&#8217;s unclear whether a seat held by an incapacitated senator would be considered &#8220;vacant.&#8221;<\/p>\n<p>CBS added that unless Johnson dies, state officials &#8220;unsure of how to proceed if he&#8217;s incapacitated.&#8221;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>MSNBC is reporting that Sen.
