Are we close to a deal on judicial nominations?

Roll Call reported today that several Senate centrists — from both parties — are near a deal that would end the stalemate over judicial nominees, at least until 2007.

A bipartisan coalition of Senators believe it is close to a deal that would avert the looming showdown between Republicans and Democrats over judicial filibusters.

The potential deal, spearheaded by Sens. Trent Lott (R-Miss.) and Ben Nelson (D-Neb.), would involve at least a half-dozen Senators from each party signing a letter or memorandum of understanding that signals how they would proceed to vote on all matters related to judicial nominations.

The six Senate Republicans would commit to opposing the so-called nuclear option to end judicial filibusters, which would leave GOP leaders short of the 50 votes they need to execute the parliamentary move to abolish the procedure.

In exchange, the six Senate Democrats would pledge to allow votes on four of the seven circuit court nominees who were already filibustered in the 108th Congress and have been renominated.

Perhaps more importantly, the six Democrats would pledge to vote for cloture to end filibuster attempts on all other judicial nominees named by President Bush, including Supreme Court picks, except in “extreme circumstances,” according to a senior aide familiar with the discussions.

There’s a lot not to like about this deal if you’re a Dem. In fact, there’s hardly anything to like at all. The Republicans would leave the ability to filibuster in tact — meaning Dems will get something they already have — and in exchange, Dems give up the right to block four extremist judicial nominees, while also giving the White House a green light to nominate a fairly radical justice for the Supreme Court.

Mutual sacrifice? Equitable concessions? Hardly.

It’s important to note, however, that it may not be up to Bill Frist and/or Harry Reid to accept or reject this proposal. It may happen whether most senators hate it or not.

The agreement would not require a single vote to be cast for it to be executed. As long as each side has at least six Senators willing to uphold it, Senate Republicans would be unable to carry out the nuclear option and Senate Democrats would be unable to execute a successful filibuster.

If Frist wanted to, he could still force a vote on the parliamentary move to end the filibuster — something he is widely expected to do sometime this month — but it would face certain defeat if the six Republicans held strong.

That’s the most interesting part of the negotiations. Frist would probably reject the deal — even though it strongly benefits the GOP — because the party base is demanding action on the nuclear option. At this point, it’s fair to say Frist doesn’t even want a compromise unless it clears the way for all of Bush’s nominees to be confirmed. Since this compromise leaves three would-be judges behind, it’s a non-starter for him.

But with at least six Republican senators (it’s unclear which six) on board for this deal, Frist doesn’t have a choice. They won’t back the nuclear option when they have this deal instead. Reid’s in the same boat, since he wouldn’t be able to keep up the filibusters if five Dems break with their party.

It’s hard to know for sure how serious these negotiations are and how close they are finalizing a deal. One aide familiar with the discussions told Roll Call, “It’s very close.”

  • Who cares what happens to Frist? The point here is that four incompetents will get lifetime judicial appointments, and we’ll end up having the nuclear option and a supreme court nominee collide.

    We already knew that Ben Nelson is a jerk, but i look forward to finding out who the other five democratic idiots are (my money is on lieberman being one of them).

  • I am against this deal. I don’t think they will get enough votes to pass the nuclear option anyway.

    Repubs: Lott, Sununu, Grassley, Gregg, Smith, Warner
    Dems: Ben Nelson, Pryor, Lincoln, Dorgan, Conrad, Bill Nelson

  • If there are six Democratic Senators who will sign on to this, they should be targeted — by the DSCC — for replacement. This is a nuclear option surrender, without even a fight!! We let them have 4 of those already filibustered and defeated last session, AND we agree to not filibuster any future Bush judicial nominees? We just surrender? Are the Democrats now going to pull a Microsoft, and switch to a “neutral” position on the nuclear option?

    Why don’t we just cut off our balls on C-SPAN and hand them over to the Repugs? And WTF does “extreme circumstances” mean? Hell, I’ll bet ALL of the Republicans are going to have a lottery to see who gets to be the lucky six that castrates the Democrats.

    We are WINNING the public debate, and the Republicans are scared shitless about this. Have we suddenly become the party of Joe “Kiss Me On the Cheek” Lieberman? How stupid can they be? Even if the Repugs break the Senate rules and eliminate the judicial filibuster, Democrats still win by closing off all action on all of the radical Repug agenda – and the government won’t shut down, and the public wants these assholes stopped.

    I just don’t get why we should allow the game to be called off when the Democrats are ahead, the Repugs hold the football, but they are on their own 5 yard line with 4th down and 85 yards to go, with time running out! Why? Why? Why?

  • Yeah – this is garbage. I honestly don’t care about the filibuster rules one way or another, the repub’s won’t control the Senate forever.

    A deal like this would be a win for them (the repubs) – Frist has an excuse as to why he didn’t get the rules changed, four bad judges get appointed, and the rules remain so the republicans can take advantage of them when *they’re* the minority.

    Bad, bad deal.

  • More I think about it, Frist won’t take this. He’s already said that he won’t accept any deal that ensures an up-or-down vote on EVERY nominee.

  • 1) The Dems can’t seem to get it thru their Sponge Bob heads that they look so beaten and worthless, it is embarassing to your average American to be seen supporting them and hard to believe that these Dems can actually fight for anything. STAND UP AND FIGHT U LITTLE SHITS EVEN IF YOU LOSE!!!!

    The Rethugs were losers for so long, yet, by the way they strut around, you’d think they’ve always owned the universe. The reality is that they arwe the biggest crybabies on the planet, but, they hide it so well.

    2)Many, if not all, of the Rethug ideas have blow-back potential, example, the bankruptcy bill. I imagine it would be great to impeach all of Bushes judges someday. Bring it on.

    I think this “compromise” is disgusting, and is just more example of the right-wing takeover of this country.

    However, give me a compromise between Barbara Boxer and Lincoln Chaffee, and *that* is a real compromise that I can sign up to. Yep, I’ll bet whatever Boxer and Chaffee cook up toghether is something I can live with, no problem.
