Cooper’s source

Time’s Matt Cooper was prepared to go to jail to protect his source, but received word early yesterday from his source that he had been released from his promise of confidentiality.

And who was this secret source? Surprising absolutely no one, it was Karl Rove.

“A short time ago, in somewhat dramatic fashion, I received an express, personal release from my source,” Mr. Cooper said. “It’s with a bit of surprise and no small amount of relief that I will comply with this subpoena.”

Mr. Cooper’s decision to drop his refusal to testify followed discussions on Wednesday morning among lawyers representing Mr. Cooper and Karl Rove, the senior White House political adviser, according to a person who has been officially briefed on the case. Mr. Fitzgerald was also involved in the discussions, the person said.

In his statement in court, Mr. Cooper did not name Mr. Rove as the source about whom he would now testify, but the person who was briefed on the case said that he was referring to Mr. Rove and that Mr. Cooper’s decision came after behind-the-scenes maneuvering by his lawyers and others in the case.

Those discussions centered on whether a legal release signed by Mr. Rove last year was meant to apply specifically to Mr. Cooper, who by its terms would be released from any pledge of confidentiality he had made to Mr. Rove, the person said. Mr. Cooper said in court that he had agreed to testify only after he had received an explicit waiver from his source.

Cooper’s notes, apparently, pointed to Rove being his source, so this simply confirms what everyone already believed.

However, it’s important to note that while this proves that Rove was a source for Cooper, it doesn’t prove that Rove leaked Valerie Plame’s identity.

Update: As Atrios notes, the Washington Post reported the opposite, saying that Rove was not the source who called Cooper yesterday morning and personally waived the confidentiality agreement. Who’s right? I haven’t any idea.

Why else would Rove have needed confidentiality?

  • I’d be interested to know what the method to Rove’s madness is here … I sure don’t get it. If he was one of the leakers, why would he waive confidentiality?

  • The TIME documents already fingered Rove so he had nothing to gain by allowing Cooper to go to jail. Miller, on the other hand, holds the name of the original leaker. Cooper’s testimony will probably deliver a perjury charge while on Miller likely hangs something much more serious.

  • To add, why is it that the investigation is suddenly springing leaks now? For over a year they investigation’s been run tighter than a sober nun.

  • EARTH TO IDIOTS: NOVAK OUTED PLAME. Why is anyone wasting breath on Miller and Cooper. Both they’re sources already waived confidentiality anyway so there is no case to pursue, and yet the powers that be still pursue. And so what if their sources didn’t sign the waiver, Miller and Cooper didn’t expose Plame’s identity – NOVAK DID. BOB NOVAK IS THE GUY. Jeezus freakin’ A…can we keep our eye on the damn ball. WHERE IS NOVAK IN ALL THIS.

  • What I want to know is, why does this source (Rove or not) want Miller to go to jail while giving Cooper a free pass???

    Hermaclitus: There could be a very good reason Novak isn’t going to jail (yet): he’s cooperating with the investigation. And, that’s why the “yet” is in there: this is the investigation phase, not the trial. Once the investigation is complete, *then* it’s time to start yelling about Novak — and the source.

  • Let’s see. Rove is in trouble, and it looks like he will be all over the press when this comes out. And a terrorist attack hits. It seems that whenever these guys get cornered, the terrorists take over the news scene. I know it’s a conspiracy theory but the timing is yet again perfect.

  • ThatTallGuy: Sorry for ranting, and I suppose you’re right about the due process being given to this case. I’m very grateful that at least it’s being looked into seriously rather than being swept away like so many other Bush admin scandals that make Watergate look like a parking ticket. However, I’m tired of the beauracracy that’s attempting to drag this thing out and wear on the public’s patience rather than just going right to the horse’s mouth thereby saving the valuable time and resources of our government. Aren’t we supposed to be at war? Do we really have time to bicker over who said what and when and to who? Nuts to that – Bob Novak, you’re going to jail whether you sing or not because what you did is a crime – period. So throw him in jail and let’s move on. This whole thing should have nothing to do with freedom of the press and the protection of a source’s identity – nothing at all Novak ruined a woman’s career – not a crime but should be – and almost got her killed by outing her while she was in the field – this is a crime. Toss him in to one of those pound you in the ass prisons (a la Office Space) and let’s get back to the other irrelevant crap – Shiavo, nuke option, private accounts, going to Mars, creationism in schools, etc. Ack…I need a drink.

  • It’s really not a case of NY Times vs Washington Post here. the Post is quoting Rove’s attorney, nothing more. the Times is putting a TAD bit more investigation into it 🙂
