DeLay indicted

It’s official — House Majority Leader Tom DeLay has been indicted on one count of criminal conspiracy by a Texas grand jury. More soon.

A Travis County grand jury today indicted U.S. House Majority Leader Tom DeLay on one count of criminal conspiracy, jeopardizing the Sugar Land Republican’s leadership role as the second most powerful Texan in Washington, D.C.

The charge, a state jail felony punishable by up to two years incarceration, stems from his role with his political committee, Texans for a Republican Majority, a now-defunct organization that already had been indicted on charges of illegally using corporate money during the 2002 legislative elections.

Update 2: The immediate question, of course, is what happens to DeLay’s position in the congressional leadership. House Republican Party rules require leaders who are indicted to step aside from their leadership posts, at least temporarily. As a result, DeLay — at least in the short term, will no longer be House Majority Leader. Speaker Hastert will reportedly recommend that Rep. David Dreier (R-Calif.) take over DeLay’s duties. Presumably, Dreier, if approved by the rest of the GOP caucus, will serve until DeLay’s trial is completed. That could be a while.

Update 3: The conventional wisdom, up until very recently, was that DeLay would avoid indictment. What happened? Originally, Travis County prosecutors said they could not pursue election code violations against DeLay because of jurisdiction restrictions — only DeLay’s local district attorney could pursue an indictment against DeLay for an elections violation, and since the local D.A. is a Republican and DeLay ally, he wasn’t about to take any action.

But, as the American-Statesman explained, today’s indictment wasn’t about elections law, it was about a conspiracy charge. That falls under the criminal code, which means Ronnie Earle can prosecute DeLay for conspiring with others to circumvent state law.

  • Absolute euphoria at Huffington Post, and I’m
    sure at all the other liberal blogs. But what does it
    mean? Maybe down goes Delay, maybe, and
    another snake takes his place. Like knocking
    off drug lords, or terrorist leaders. Nothing
    changes.

    How does this work its way up to Bush? Delay
    is a truly horrible man, but there are no end
    of equally vile, contemptible creatures to
    carry on.

    How does this bring down the radical right?
    I can understand the cheers, but I’m reading
    dozens of comments that this is the beginning
    of the end. I don’t see it that way, anymore
    than Agnew brought Nixon down.

    b) you’re right, but so many of us have been waiting for some kind of indictment for so long, I’m going to party today and dwell on what’s changed tomorrow.

  • While the cynic in me sides with Hark, this IS a watershed moment in the ongoing political climate. DeLay had basically been daring everyone for years to lay a hand on him. His power and influence in DC seemed to know no bounds. Hastert himself owes his job to DeLay. And now, after so many, many scandals that the GOP has been able to dance through, here’s one scandal that’s finally sticking.

    Waiting in the wings are Plamegate, Fristgate and the Abramoff imbroglio.

    Maybe not the beginning of the end, but…perhaps the end of the beginning?

  • Well, it’s about time isn’t it?!
    DeLay is the first to fall. Look for the next few days
    and weeks to bring in bigger news of Repbulicans
    falling from grace. Rove and Cheney better watch out because the
    net is coming for them, too.
    If I were the Republicans I’d be getting those resume’s in order about now.
    They’re going to need them. I’d also recommend calling a good lawyer.

    How can the premier anti-gay group in America (the Republican Party) have a GAY (albeit closeted) man as its House Floor Leader?

  • I was amused yesterday that MSNBC had an entire article up within minutes of the announcement, whereas most other sites just had a ‘breaking news’ paragraph.

    Made me wonder if they didn’t have it pre-written, the way some places pre-write obituaries of celebrities who are getting on in life, just to save themselves some time 🙂

    I must admit, every time I’ve heard the words ‘DeLay indicted’ it’s made me smile.
