And so it begins…

Just 22 months after launching a federal investigation, the wait is over.

It’s official, Scooter Libby has been indicted. As of 12:44, CNN reported that there are at least three charges, including obstruction of justice, perjury, and making false statements.

More soon.

Update: There were a total of five charges, including one charge of obstruction of justice, two counts of perjury, and two counts of making false statements.

Update 2: More specifically, Libby’s obstruction of justice occured in Spring 2003, perjury on March 5 and 24 of 2004, and false statements on October 14 and 27 of 2003.

Update 3: In case there was any doubt, Fitzgerald said Plame was undercover and her outing was dangerous:

Prior to the July 14, 2003, Valerie Wilson’s employment status was classified. Prior to that date, her affiliation with the CIA was not common knowledge outside the intelligence community. Disclosure of classified information about an individual’s employment by the CIA has the potential to damage the national security in ways that range from preventing that individual’s future use in a covert capacity to compromising intelligence-gathering methods and operations, endangering the safety of CIA employees and those who deal with them.

Update 4: Libby has officially resigned. CNN is reporting that Libby tendered his resignation this morning, knowing that this indictment would be forthcoming, but it’s official now.

Update 5: Paul Begala just noted that this is the first time in 135 years that a senior White House official is under indictment.

Update 6: The Smoking Gun has the indictment itself posted online. So, not incidentally, has Fitzgerald’s office.

Update 7: Fitzgerald’s press release, laying out a great deal of what the grand jury learned, is now online.

  • Okay – who has pity for Scott McClellan and hist next briefing?
    Anyone? ?? No one… fine.

    When the White House was asked specifically whether Karl Rove, Elliot Abrams or Lewis Libby told any reporter that Valerie Plame worked for the CIA, White House spokesman Scott McClellan said: “Those individuals — I talked — I spoke with those individuals, as I pointed out, and those individuals assured me they were not involved in this.   • hark – doesn’t mean this is it for the investigation, just that this is it for today (believe me, that was my first question!)

  • So unlike Clinton’s investigation the results may actually include a crime and not just a cover-up? Maybe “hot” Karl got a pass on obstruction because he is getting the brunt of the Espionage charges. Hark. I feel your pain. Let’s wait until Fitzy finishes talking. These are only preliminary documents.

    That said there better be more!

  • Another rumor:

    As a parting gift, Rove will present Libby with a new alrm clock. Instead of buzzing or ringing, a tinny voice will intone, “Will the defendant please rise.”

  • I was thinking about Scott “on-going-investigation” McClellan too, anyone care to wager what his new catch-phrase will be? I’m going with “on-going-trial”, cuz they’re fucking dumb and that’s all they can come up with.

  • Well I’m surprised there were any idictments at all. This is good news. However they are Perjury charges which is something Fox News will be able to easily spin this and convince the majority of Americans that this crime is equivalent to the “crime” of cheating on an elementary school spelling test.

    Also Rove is still untouched, and hopefully Fitz will continue the investigation but I’m convinced Rove will end up walking free. No one has yet to be held accountable for the main crime here and that was the exposure of an undercover CIA agent’s identity. I won’t be happy until someone high-up is held accountable for this crime.

  • Patience, Hark. CB says there is still a press conference coming in a few hours. Update 3 confirms there was indeed a crime committed. Someone is gonna get charged with committing it. (Here’s hoping Cheney get charged!)

  • From Fitzgeralds posted inditement (#22 on Pg 8): “On or about July 12, 2003, LIBBY flew with the Vice President and others to and
    from Norfolk, Virginia, on Air Force Two. On his return trip, LIBBY discussed with other officials
    aboard the plane what LIBBY should say in response to certain pending media inquiries, including
    questions from Time reporter Matthew Cooper.”

    SO they all discussed how to deal with Cooper’s questions two years ago. Conspiracy theory anyone?

  • Re #11, no comment since: a) there is “on-going-investigation” (which is still true) or b) “he is no longer a White House employee”.

  • I’ll still be surprised (very pleasantly, of course) if anything substantial comes of all this. Leaky Libby is hardly worth all the fuss. The Bush Crime Family could care less about people like him. The Family itself will remain untouched, and that’s all they care about.

    And I can’t really blame McClellan. I have to pity him, really. He’s got an incredibly unenviable job, and he’s really just a mouthpiece. He says what the White House tells him to. And when they get caught lying their asses off, his job is to take that heat. A lot like phone customer service reps. They didn’t screw up whatever it is you bought, nor can they actually do anything about it for you, they’re just put there to get bitched out for the company.

    CBBB, we need to be prepared to counterspin that by pointing to the attacks on Clinton for what? Lying about a non-crime. It will be totally hypocritical of Fox if they try to play down perjury or false statement charges. Like the Congressman (whose name escapes me) that CB mentioned earlier this week.

  • Libby is merely the sacraficial lamb for the Bushies. He probably won’t even get a hard prision sentence even if convicted on all counts.

  • Has anyone read the indictment yet? I have, and I just have one question. Who is “Senior Official A?” This, to me, is the important part. This official has been identified as the person who spoke with Novak. You want to bet it was Rove?

  • I just don’t understand. The Bush White House is essentially a religious cult – why would Libby willingly take the fall for all of them – I mean I don’t except Libby to get much of a punishment if he is found guilty (8 months prision time MAX) but he just got fucked over big-time by this “all in this together” mentality that seems to be the religion of the White House – give your life for the glory of Bush and Cheney.

    Has to be Rove. I’m not even sure why a pseudonym is necessary.

  • NYTimes said today that “charges lodged today could spell professional ruin for the 55-year-old lawyer, unless he is acquitted or the charges are dismissed”. It’s funny how naive they can still be. Anyone want to bet that, even if he is found guilty at trial, he will do minimal if any jail time, and once done with said jail time, will be safely lodged in a corporate management/board of directors position, making more money than the sum of all the posters here…?

  • Of course he will. He’s a Bush Administration Republican – he will be considered a hero. If he even goes to jail there will be huge parades in the streets when he gets out (after 3 weeks) – the judge who sent him there will beg for his forgiveness. No one wants to have a criminal on their corporate board but if he’s a republican criminal than that’s a totally different story. Of course by definition a republican is a criminal.

  • I believe “Offical A” is Rove as well. There is an outside shot that it could be Cheney.

    McClellan chose this job and knew who we was working for when he took it. He could step aside, but this is what he wants to do. I have no pity for him and there should be no pity for him.

  • McClellan is just the White House bitch. I have no pity nor respect for that man, he tells lies and falsehoods for a living.

  • “Senior Official A” seems more like Bolton to me. He seems more likely to have known about Plame and her position, Plus, he’s apparently a world class jerk.

    By the way, I was impressed with Fitzgerald and his careful attention to individual RIGHTS under the law. As much as I detest some of the White House characters, the fundamental presumption of innocence is vitally important. I wish the Bushies gave that some thought in regard to some individuals long locked up for suspected — not alleged — terror activities.
