Justice Department: Bushies’ hiring practices broke the law

Remember Monica Goodling, Kyle Sampson, and the team of Bushies who blatantly politicized the employment practices at the Justice Department? Including the selection of judges? In case there were any lingering doubts, the Bush gang’s conduct was apparently literally criminal.

Former Justice Department counselor Monica M. Goodling and former chief of staff D. Kyle Sampson routinely broke the law by conducting political litmus tests on candidates for jobs as immigration judges and line prosecutors, according to an inspector general’s report released today.

Goodling passed over hundreds of qualified applicants and squashed the promotions of others after deeming candidates insufficiently loyal to the Republican party, said investigators, who interviewed 85 people and received information from 300 other job seekers at Justice. Sampson developed a system to screen immigration judge candidates based on improper political considerations and routinely took recommendations from the White House Office of Political Affairs and Presidential Personnel, the report said.

Goodling regularly asked candidates for career jobs, “What is it about George W. Bush that makes you want to serve him?” the report said. One former Justice Department official told investigators she had complained that Goodling was asking interviewees for their views on abortion, according to the report.

If this sounds familiar, there’s a good reason. The Justice Department’s inspector general is releasing the results of a lengthy investigation in four parts, and this is the second. The first was released about a month ago, and documented six years of illegal hiring practices relating to the Justice Department recruiting new attorneys (those with “liberal-sounding resumes” were barred from employment). Today’s report documents the allegedly illegal conduct from Goodling and Sampson (among others). Still to come are reports on hiring problems in the civil rights division and the dubious purge of nine U.S. attorneys.

That said, today’s report, which is online (.pdf), is a doozy. The Bush gang wasn’t just involved in blatantly criminal acts, their conduct had consequences for the nation.

The improper personnel moves deprived worthy candidates of promotions and damaged the credibility of the Justice Department, investigators wrote. An experienced counterterrorism prosecutor, for example, was kept from advancing in favor of a more junior lawyer who lacked a background in terrorism.

The procedures imposed on immigration judge candidates caused serious delays in appointing judges at a time when the courts suffered under a heavy workload, the report said.

In the case of the counter-terrorism official, the highly-qualified applicant was rejected “because of his wife’s political affiliations.” This, of course, a) is insane; and b) necessarily undermined our national security interests.

What happens next? Many of those caught up in this scandal have already resigned in disgrace, but that hardly absolves them. Some will almost certainly be stripped of their law licenses, and some may yet face criminal prosecution.

House Judiciary Committee Chairman John Conyers, Jr. and Commercial and Administrative Law Subcommittee Chairwoman Linda Sanchez had the following response to today’s Department of Justice Inspector General/Office of Personal Responsibility Report on “An Investigation of Allegations of Politicized Hiring by Monica Goodling and Other Staff in the Office of the Attorney General.”

“Today’s report describes ‘systematic’ violations of federal law by several former leaders of the Department of Justice,” said Conyers. “Apparently, the political screening was so pervasive that even qualified Republican applicants were rejected from Department positions because they were ‘not Republican enough’ for Monica Goodling and others. The report also makes clear that the cost to our nation of these apparent crimes was severe, as qualified individuals were rejected for key positions in the fight against terrorism and other critical Department jobs for no reason other than political whim. The Report also indicates that Monica Goodling, Kyle Sampson, and Alberto Gonzales may have lied to the Congress about these matters. I have directed my staff to closely review this matter and to consider whether a criminal referral for perjury is needed.”

“The House Judiciary Committee’s investigation into the politicization of the Department of Justice has been criticized by the Minority as a fishing expedition that has caught no fish,” said Sanchez. “This report, which found that Monica Goodling and many other Justice Department officials committed misconduct by violating both federal law and Department policy, adds to a growing public record that this Administration has tainted our system of justice.”

It’s tough competition, I know, but the politicization of the Justice Department has to rank right there on the list of the Bush administration’s most disgraceful scandals. Top three, easy.

  • In a statement, current Attorney General Michael B. Mukasey said the department had already moved to institute changes to the hiring process and said he would consider more in light of today’s report.

    Anyone want to bet that Mukasey never finishes considering “more” before the administration ends? I will be shocked if there are ever any negative consequences for any of the Bush administration’s crimes.

  • I can accept conservatism as a legitmate point of view – one that leans toward the Jeffersonian philosophy that those who govern least govern best. I can understand conservative distrust of big government. What I am always appalled at is that the Republican Party has NO real conservative values.

    The actions of the Bush administration, from politicizing the justice department, to illegally wiretapping, to the suspension of habeus corpus, to naked power grab of the White House through the unitary executive, to corporate welfare, to no-bid contracts, to attacking rather than defending the balance of powers created by the Constitution, etc., etc., should absolutely outrage any real conservative.

    The lack of outrage by “conservatives” toward this administration shows that “conservatism” for them is not a set of principles but rather a disguise that hides a much darker agenda.

  • i don’t know howard – for all i know he’s a typical rightwing douchetroll – but to be fair, he ddn’t say liberals politicized federal hiring practices too. He said he wouldn’t be surprised if Monica Goodling claimed such a thing to absolve herself of guilt. After all, she did imply during her testimony that being asked for her testimony was partisan politics in the first place.

    Jeez, cool your jets, people. howard is a regular commentator at Kevin Drum’s, Matt Yglesias’ and elsewhere and definitely not a right winger. TR is correct in that howard was predicting, not endorsing Goodling’s action.

    Good Lord, I am a college professor and I honestly believe that classroom discussion has deteriorated significantly in the last 6 -8 years. Students who are willing to comment simply attack and name call and the greater number of students simply remain quiet. It is sad.

  • In my opinion, nothing come close to lying the nation into a trillion dollar war, or inflating terrorism to the transcendent issue of our time. That’s kept us from addressing the real global crises of the 21st century, and our urgent domestic problems. Although not technically a scandal, I’d say his fanatical application of supply side economics has done grave and irreparable harm to the middle class, the backbone of our society.

    And then there’s the assault on the Fourth Amendment, and the torture scandal.

    So as bad as this is, I think it pales to insignificance when compared to the entire litany of Bush’s crimes and misdeeds.

  • This really should be enough information to allow the Obama administration to ask all the appointees of the Bush era to hand in letters of resignation, and then sort through them to get rid of the creeps that have no business being in government. They will only be there to torpedoe the Obama administration, and make a path for the next criminal Republican administration.

  • If the Democrats had a gut to share among them, come January 21, 2009 when they have a solid majority in both houses of Congress, they’d appoint a special prosecutor to investigate Mukasey with a view to possible obstruction of justice charges. Not going to happen, though.

Further, the American People will be treated to an undercover investigation that reveals how John McCain has secretly donated his unnecessary limbs and organs to Walter Reid Hospital, and has given personal foot massages to all soldiers who reenlist.

    I won’t get into a ranking argument, but in addition to the systemic issues Racer X noted, there’s the angle that this is the Justice Department we’re talking about. Fair trials, fair elections, compliance with international law, investigation and prosecution of wrongdoing, protection of constitutionally guaranteed rights — basically the administration of justice across the board all goes out the window when the Attorney General sees his role as that of the President’s lawyer. And when the Department is reconfigured to further the goal of achieving a permanent Republican majority, we’re talking about a political takeover of an entire institution whose mission is bound up with being apolitical.

If anyone thinks that the DOJ was the only agency where these practices were in effect I’d guess that they’re way wrong.   • No one currently in this criminal regime is going to go after any of the earlier perps. And the next regime, no matter whose it is, won’t either. The principle that you can’t be prosecuted for policy disputes, even if what you did is technically illegal, has been firmly implanted in government by several administrations. Consentual sex in the oval office, which isn’t illegal, is a capital offense, however.

    How can we not be a total laughingstock to that part of the world which still believes in the rule of law?

    I think this will be *yet another* instance of “from a big cloud, a small rain” (z duzej chmury, maly deszcz) or, as Cheney says: “So?” Reports come and go but very little action follows in their wake.
    “Goodling” is nowhere near as interesting/exotic a name as “Lewinsky” and nobody will remember it next week.

    As I understand/remember it from, reading some of the postings related to the subject last year… What you are proposing is actually the custom… All AG’s turn in their resignations at the end of the Presidency, and it is up to the New President to either accept the resignation, or to ask them to keep serving.

    Hence the Republican claim that “Clinton did it too!” Clinton did accept some of the resignations, as did many presidents before Bill Clinton. . However that wouldn’t have fit in with their “Clinton did it too!” mantra if the masses knew that their semi-god Reagan fired more AG’s than Clinton did.

Its obvious this country is split 50/50 on these issues based on the election results and the polls. Everybody that votes has a say so stop bashing each other for whatever belief they may have. Thier view is just as valid as yours, even if you dont like it. You dont get a vote on the fact that they get a vote. Please, please I beg of you dont start with the disinfanchised peoples argument. People get disenfranchised all the time in a Republic, it’s part of being in a Republic vs being in a Democracy. People under 18 cant vote, felons can’t vote. Living in NJ I can’t vote for a mayor in California. Deal with it, votes get counted, somebody gets elected. Somewhere in there somebody is going to get overlooked. So stop whining and start working together to make this country a better place, where both of you can live.

    Compramise is not both people not getting what they want, it is getting some of what both people want.

  • You know, I’ve never been able to quite forget that little “slip” that Monica Goodling made when she was testifying. Remember? She said that she’d taken “an oath to President Bush”, then corrected this to “an oath to the Constitution”. Far as I know, nobody ever challenged that or followed it up.

    But just supposing it was true? Maybe they ALL pledged allegiance to Georgie? They always say that the rot starts at the top.
